H&R block didn't send out my Amended taxes, what are there obligations to me?

I filed my taxes through H&R Block and needed to have them Amended, which i also did through them. I have been waiting 4 months and i have called the IRS a couple times and was told they take 12-16 weeks. After my call to them today they told me the still have not seen them and to call H&R block to find out if they knew anything, I called and they didn't have anything on record. So i was going back to find the receipt that i paid for them to be amended and in the process i found the envelopes containing my amended state and federal taxes that THEY were supposed to send!! They gave me my envelope with my taxes records and i assumed that only my copy was inside while in fact EVERYTHING was. How can they charge me to amend them and not know they didn't send them in? Were they thinking free money in pocket? What am i entitled to get from them?? This is THEIR fault and now i will have to wait another 3-4 months for my taxes back?!?!? It is also very conveint that the year round locations are open 3 ays a week for 3 hours!!
